The Means Test.

 

if you’ve researched the bankruptcy process, you’ve no doubt heard of the “means test.”  The means test does two things: 1) it determines an individual’s eligibility for Chapter 7; and 2) if he or she does not qualify for Chapter 7, the means test establishes what they are required to pay back in Chapter 13.

 

Credit Counseling.

 

This is required by the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) of 2005.  It is a pre-requisite to filing bankruptcy and must be conducted by a certified credit counselor.

 

The Paperwork

 

I will prepare all of the paperwork.  This includes your petition, schedules (related to income and expenses) and all related documents.  I will also complete your means test. This will determine which chapter of bankruptcy you can file under (Chapter 7 vs. Chapter 13).  Remember, I do everything I can to make this process as smooth as possible.  I will pull your credit report to obtain your creditors.  I will be with you every step of the way.

 

After your bankruptcy case has been filed, you will have a creditor meeting.  If you filed a Chapter 7 bankruptcy, the timeline for discharge (the legal court order extinguishing your responsibility on your debt) is approximately 4 months.  If you filed a Chapter 13 bankruptcy, the timeline for discharge is 3-5 years.  I will recommend either a Chapter 7 or Chapter 13 bankruptcy based largely upon what you qualify for, and what your ultimate goals are related to any property that you may intend to keep.
